Being a contractor, and a party to several union contracts, I would agree with what you are saying.
I appeared at a grievance panel for a Teamsters local last week. The issue was unclear contract language as it applied to overtime for casual hires on Saturday.
Even though the language was unclear, myself and one other of the four panel members were negotiators for that contract. I was on the Managment side of the table, and the other party was on the Union side. We were able to explain what the true intent of the language was between the parties at the table at the time.
It is true that good faith and intent play the major role in contracts. There also has to be something known as "a meeting of the minds", or a contract can be thrown out, even if it was signed.
Bad contracts are often enforced, however, they can be challenged. For example, our poor contract language is now clarified by our panel decision, which will be used in the future when this issue comes up again.
