The child's home-schooling standards can be evaluated by the California Dept. of Education. The father is essentially saying he doesn't want his child raised in the mother's religious faith. That's a hard one to convince the court in a custody dispute, but TFI's anti-semitism is a good place to start.
If I were the father, I'd be concerned right now that the mother will abuduct the child and disappear to a selah home. The evidence regarding child abduction among Family members could be brought to court as a rationale for giving the father temporary custody until the mother's parental rights can be fully determined.
