My point is that it is simply a legal fiction, a mere technicality, to say that Activated Ministries is not TFI. While it may be strictly correct, imo, a strict interpretation of the law with regard to this issue, in other words one that does not consider any other factors, results in a perversion of the facts, which any judge could see through.
If it ever becomes an issue that a court has to deal with there are plenty of things that could be argued to counter the technical argument that AM is not TFI.
You say it is not factual to say that AM is not TFI. I say that that is a mere legal fiction, and for all intents and purposes AM is TFI.
