There is no excuses that can be made. After World War 2 soldiers were put on trial for what had happened to the jews, the excuse of just following orders was not allowed.
One important thing is that if it was a 'one time' incident, that the victim should have a choice, not because laying pressure on the victim, but because they may not want the publicity of having a court case.
I know one young adult and she said she would not prosecute even if the guy came back , as she would not want to go through court cases and publicity.
But I think if she thought it was more then a one off case,(if the guy was still in to it) then she would no doubt prosecute.
