The question is not who the photo is of.
The photographer or the family may have copyrighted the photo. If so it is a violation of copyright to use the photo without their permission.
Chances are the photo was never copyrighted (I'm sure the family didn't copyright all the photos especially those of Berg). The process is expensive and requires depositing an original with the copyright agency.
